1.- Ownership of the Website

2.- Use of the Portal

This Legal Notice (hereinafter,”Legal Notice”), together with the General Conditions (hereinafter,”General Conditions”), establish the conditions that regulate the use of information society services that MUSICAL ARTS makes available to Internet users through the Website. Aspects related to the processing of Users' personal data in connection with the use of the Website are regulated in the Privacy Policy.

In this way, access and use of the Website implies that the user of the Website (hereinafter, the”User”) accepts in full and undertakes to fully comply with this Legal Notice, the General Conditions, the Privacy Policy as well as the instructions or recommendations indicated to it in each specific case.

Access to the Website is free, except for the cost of connecting through the telecommunications network provided by the access provider that the User has contracted.

MUSICAL ARTS reserves the right to make, at any time and without the need for prior notice, modifications and updates to the Website and its contents, configuration and presentation, including this Legal Notice and the General Conditions, so we recommend reading them before each access and navigation through the Portal.

The User undertakes not to use the Website for fraudulent purposes, as well as not to carry out any conduct that could damage the image, interests and rights of MUSICAL ARTS or third parties, requiring them to use the Portal, the services and the content included in it in a diligent, correct and legal manner. In particular, the User undertakes to refrain from: deleting, evading or manipulating “copyright” and other data identifying the rights of its owners incorporated into the contents of the Portal, as well as technical protection devices, or any information mechanisms that may include such content. In addition, the User undertakes not to perform any act in order to damage, disable or overload the Website, or to prevent, in any way, the normal use and operation of the Website.

If you fail to comply with this Legal Notice and/or the General Conditions, or in MUSICAL ARTS we reasonably suspect that you are not complying with them, MUSICAL ARTS reserves the right to limit, suspend or terminate your access to the Website, taking any technical measures that are necessary for that purpose. In addition, MUSICAL ARTS reserves the right to decide, at any time, on the continuity of the services it provides through the Portal.

3.- Intellectual and industrial property.

Intellectual property rights over the layout of the contents of the Website (including sui generis right to the database), its graphic design (Look & Feel), the distinctive signs (brands and trade names), the underlying computer programs (including source codes), as well as the different elements that make up the Portal (texts, graphics, photographs, videos, etc.) correspond to MUSICAL ARTS or, where appropriate, has the right to use and exploit them, and in this sense they constitute works protected by current intellectual and industrial property legislation.

The use of the Website by the User in no way implies the transfer of any intellectual and/or industrial property right over the Portal, its contents and/or the distinctive signs of MUSICAL ARTS. For this purpose, by means of this Legal Notice, except in those cases in which it is legally permitted, the User is expressly prohibited from reproducing, transforming, distributing, communicating publicly, making available, extracting and/or reusing the Website, its contents and/or the distinctive signs of MUSICAL ARTS.

The reproduction of elements or contents of the Website made for profit or commercial purposes is expressly and strictly prohibited.

4.- Limitation of Liability

The User acknowledges and accepts that the use of the Website is carried out at all times at their sole risk and responsibility, so MUSICAL ARTS is not responsible for any misuse or misuse that may be made of the Portal. For this purpose, you will only be responsible for any damages that the User may suffer as a result of the use of the Website, when such damages are due to our malicious action.

In particular, MUSICAL ARTS will not be responsible for:

— Damages of any kind caused to the User's computer equipment by viruses, worms, trojans or any other harmful element. The User acknowledges that the use of the Internet network implies the assumption of a risk that their computer equipment may be affected by the elements mentioned above. To this end, it is up to the User, in any case, to have adequate tools for the detection and elimination of harmful electronic programs.

— Damages of any kind caused to the User that result in failures or disconnections in telecommunications networks that result in the suspension, cancellation or interruption of the Website service during the provision of the Website or previously. In this regard, the User acknowledges that access to the Portal requires services provided by third parties outside the control of MUSICAL ARTS (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation do not correspond to MUSICAL ARTS.

In the event that the User considers that there is a Linked Site with illegal or inappropriate content, please inform MUSICAL ARTS via contabilidad@musicalarts.es. Under no circumstances will this communication entail the obligation to remove the corresponding link.

The existence of Linked Sites in no way implies that MUSICAL ARTS has effective or other knowledge of the services and contents of the same in case of illegality, nor does it necessarily have agreements with the managers or owners of the Linked Sites. Nor does the existence of such links imply recommendation, promotion, identification or compliance. MUSICAL ARTS with the statements, content or services provided through the Linked Sites. Consequently, MUSICAL ARTS is not responsible for the content of the Linked Sites, nor for their conditions of use and confidentiality policies, and the User is solely responsible for checking and accepting them each time they access and use them.

The User and, in general, any natural or legal person who intends to establish a link from their page or site to the Portal, must obtain prior written authorization from MUSICAL ARTS. Users accept compliance with and respect for this point.

In the event that any of the provisions contained in this Legal Notice is declared null and void, it will be removed or replaced. In any case, this declaration of nullity will not affect the validity of the other provisions contained in this Legal Notice. &
